U radu je analizirana dužnost sudova u obrazloženjima svojih odluka dati odgovor na glavno pravno pitanje u predmetu. Odnosno, zahtjev da obrazloženja sudskih odluka udovolje kategoriji dostatnosti i ...sadrže razloge o odlučnim tvrdnjama stranaka. Ovo traži zaštita prava na pošteno suđenje iz članka 6. stavka 1. Konvencije za zaštitu ljudskih prava i temeljnih sloboda te članka 29. stavka 1. Ustava Republike Hrvatske. Istražena je praksa Europskog suda za ljudska prava i Ustavnog suda Republike Hrvatske, a posebno se osvrnulo na dva predmeta u kojima je pružena zaštita pravu na pošteno suđenje u građanskim stvarima uslijed povreda koje su se ticale navedenih kategorija. Prikazana je i veza s nacionalnim pravilima o bitnim povredama parničnog postupka iz članka 354. stavka 2. točke 11. Zakona o parničnom postupku te uočeno kako se zahtjevi s naslova zaštite prava na pošteno suđenje od arbitrarnosti šire u koncentričnim krugovima, pa i na odštetnopravne postupke u stadiju odlučivanja pred osigurateljima.

They are also trying to set some connections between so called common European identity as necessary condition to give legitimacy to the European Constitution. This became important question after "votes of nonconfidence" to the European Constitution in France, despite it should be addressed already before. However, European Constitution is important document on the path of European integration and lack of support to it will slow down this process of widening and deepening European ties.
During the last thirty years the European Court of Human Rights has been developing,at an expanding pace, positive obligations under the European Convention. This monograph seeks to provide a ...critical analysis of the burgeoning case law concerning positive obligations, a topic which is relatively uncharted in the existing literature. Positive obligations require many different forms of action by member states, ranging from effectively investigating killings through to protecting peaceful demonstrators from violent attacks by their opponents. The contemporary significance of these obligations is graphically illustrated by the fact that it is the obligation upon states to provide fair trials to determine civil and criminal proceedings within a reasonable time that is the source of the overwhelming majority of complaints to the European Court in recent years. The study examines the legal bases and content of key positive obligations. Conclusions are then drawn concerning the reasons for the development of these obligations and areas of potential expansion are identified.

v Maďarsku.- The paper focuses on the development of the structure and judgments of the Hungarian Constitutional Court between the period of democratic transition and present days. First part of paper concentrates on the model of selection and nomination of constitutional judges in Hungary. The following parts of the article deal with the current theoretical and practical dilemmas of the Hungarian Constitutional Court.
