After outlining the basic relevant characteristics of the Czech constitutional amendment in the Czech Republic. After outlining the basic relevant characteristics of the Czech constitution (poly-legality, rigidity, etc.), the paper examines procedural issues of formal constitutional amendment and studies further requirements regarding such constitutional changes, esp. the role of Art. 9 of the Consttitution Several varieties of informal constitutional changes are then briefly presented. The paper assesses the current situation regarding processes of both formal and informal constitutional changes, finding the formal requirements prescribed for a constitutional amendment as sufficient for the relative stability of the constitutional system, being neither extremely strict not benevolent. The paper also points out several open questions regarding the practical application of the unamendability provision of Art. 9(2) of the Constitution in relation to potential constitutional amendments adopted through a constitutional referendum. Polazeći od toga da je ustavno pravo na predstavku, kao dio šireg pojma prava peticije, uređeno nizom različitih zakona i drugih propisa u Republici Hrvatskoj, u ovom radu nastoji se odgovoriti na ...istraživačko pitanje je li važeći normativni okvir uređenja predstavki koherentan. U tom cilju, u radu se pristupa pojmovnom određenju predstavke i izlaže način njezina pravnog uređenja u Republici Hrvatskoj, nakon čega se pobliže razmatraju razlike u važećem normativnom okviru i mogući problemi koji izviru iz postojećeg načina razrade toga ustavnog prava, ali i sugeriraju potencijalna rješenja. Usto, razmatraju se stvarni učinci izloženih propisa na postupanje državnih i drugih tijela po predstavkama, kao i različiti pristupi uređenju predstavki u usporednom pravu. Na toj podlozi, izvodi se zaključak o nekoherentnosti važećega normativnog okvira uređenja predstavki koji izvire iz, prvo, razlika u terminologiji, drugo, nepostojanja ustavne i zakonske definicije predstavke, treće, razlika u rokovima za davanje odgovora na predstavku, četvrto, razlika s obzirom na ovlaštenike prava na predstavku i, peto, razlika u pogledu sankcija za osobe koje onemogućuju ostvarenje toga ustavnog prava.

Je založen na předpokladu, že chápaní Parlamentu a vysokých soudů jako institucí sdílících legislativní suverenitu – relativně populární představa v Británii – může mít určitou vypovídající schopnost i na český ústavní systém. Popisuje přitom základní britská myšlenková schémata ohledně bipolární suverenity a snaží se je při kritickém vyhodnocení použít jako myšlenkovou inspiraci pro reflexi české ústavní teorie, která je spolu s vyhodnocením britské debaty nastíněna v další části textu. Největším problémem, který se však doposud nepodařilo uspokojivě vyřešit, je balancování na hraně mezi oběma takovými suverény.
Na Britských ostrovech tak Trevor Allan upřednostnil soudní převahu (soudy u něj mají pravomoc vyplývající ze samotné podstaty ochrany práv), Paul Craig se pak postavil na stranu Parlamentu. Jak ale Paul Craig připomíná, je slabý soud, který sice nemůže zrušit zákon, ale může ho prohlásit za nelidský? Článek tak ohledně české teorie vede paralelu mezi pojetím Pavla Höllandera a Trevora Allana, přičemž jim přiznává značnou působivost, kterou však v závěru relativizuje.- The paper aims at connecting empirical legislative power with the theory of its legitimacy. The basic claim of the paper is, that the quite common British concept of shared legislative sovereignty is able to produce a certain descriptive outcome if applied to the Czech constitutional system.Most
prominent British models are consequently described and evaluated in order to conclude parallels to the Czech constitutional theory. These parallels are discussed in the next chapter. The attainment of a stable position on the edge between two sovereigns, however, fails to be achieved and represents
the most complex issue. The paper argues that Trevor Allan prefers judicial supremacy (with courts able to invalidate the statute just because of the nature of human rights protection) and that Paul Craig favors the Parliament.Nevertheless,Paul Craig raises an important aspect – is the so called weak court without the power to strike down Parliament’s legislation still weak, when it can declare the legislation to be inhumane? Článek osvětluje okolnosti, za nichž vznikla, byla projednána a schválena. Byla připravena překotně, v informačním vakuu a bez konzultace lidu coby originárního ústavodárce. Nepožívá z uvedených důvodů plné autority a chybí jí předporozumění. I proto, že je sepsána stručně, naléhavě se žádalo, aby byla jasně vyložena. Ústavní soud však k tomu nedostal dostatek příležitostí a jeho výklad nebyl vždy koherentní. Doktrína v důsledku své atomizace výklad Ústavy spíše ještě rozkolísala. Z obou uvedených důvodů se žádá podrobit Ústavu z r. 1993 komplexní revizi a případně do r. 2020 (stoleté výročí první československé ústavy) vypracovat Ústavu zcela novou. Článek obsahuje v tomto ohledu náměty.- The Constitution of the Czech Republic entered into force in 1993. This article explains the circumstances in which it was drafted, discussed and approved. Hurriedly prepared, in a context which was characterized by a lack of transparency and consultation of the original constitutional authority, the People, the Constitution of the Czech Republic lacks “prior understanding”. Given its concise text, the adoption of a clear harmonized interpretation was necessary. However, the Constitutional Court is neither granted sufficient tools nor occasions and its interpretation of various
constitutional provisions has not always been consistent. The Czech doctrine, which is rather fragmented, has also failed to limit the ambiguities in the interpretation of the Constitution.For these two reasons (problems of legitimacy and lack of a unique, consistent interpretation) it should be decided
to examine in- depth both the text of the Constitution and its implementation and, to draft, possibly by 2020 (the centenary of the first Czechoslovak constitution), an entirely new Constitution. Jeho základní tezí je, že tato omezení jsou vhodným a užitečným institutem, jsou-li nastavena správně.Nejprve se proto obecně věnuje parlamentní pravomoci schvalovat rozpočet a dokazuje, že její omezení v zájmu ochrany udržitelnosti veřejných financí je nejen přípustné v demokratickém státě, ale dokonce podporuje původní smysl, pro který byla parlamentu svěřena. Dále charakterizuje různé typy numerických i institucionálních rozpočtových pravidel a hodnotí je podle jejich efektivity a proti-cyklického charakteru. Na základě těchto kritérií dochází k závěru, že optimálním modelem je kombinace numerického pravidla limitujícího strukturální deficit s nezávislou rozpočtovou radou s poradním postavením, která přispěje ke kolektivnímu vynucování numerického pravidla ze strany voličů a účastníků finančního trhu. Smyslem má být podpora, nikoliv odstranění politického procesu v rozpočtových otázkách. V závěru se článek věnuje hodnocení konkrétních legislativních návrhů, které byly v České republice předloženy, a doporučuje jejich úpravy- The article deals with budgetary constraints currently being constitutionalized in the EU countries, also as a result of the European Fiscal Compact. The main thesis is that these constraints are a desirable and effective institution, if set correctly. The first part of the text examines the parliamentary power to approve the budget. It argues that its restrictions to protect the public finance
sustainability are not only permissible in a democratic state, but even support the original purpose for which the power was entrusted to Parliament. The next part describes various types of numerical and institutional budgetary rules and evaluates them on the basis of their efficiency and counter-cyclical
nature. It concludes that the best model is a combination of a numerical rule limiting structural deficit with an independent advisory fiscal council. The council’s opinions and recommendations on fiscal policy are to support collective enforcement of the numerical rule by voters and actors of financial market. The overall purpose of the rules must be a support rather than replacement of political process in fiscal issues. Táto participácia nie je totožná s jednoduchým vplyvom na ústavodarné procesy. Nasledovanie zahraničných modelov môže byť aj viac-menej dobrovoľné. Mnohé nové štáty Európy v 19. storočí napríklad nasledovali belgickú ústavu z roku 1831. Aj vplyv britských a francúzskych riešení bol intenzívny. Počas dlhého obdobia v 20. storočí bol zase typický
vplyv sovietskeho ústavného modelu. Aktívna medzinárodná alebo zahraničná právna a politická asistencia v ústavodarnom procese je úplne iná záležitosť.Vtiahnutie zahraničných a medzinárodných faktorov do tohto procesu môže byť priame alebo nepriame. Daná štúdia sa najprv zaoberá tzv. hard formami medzinárodnej právnej asistencie, potom zase jej miernejšími soft formami. Potom sa štúdia sústreďuje predovšetkým na vývoj v 20. storočí, ale krátko venuje pozornosť aj udalostiam z 19. storočia (budovanie nových štátov na Balkáne). V záverečnej časti je reč aj o podobe ústavnoprávnej asistencie v posledných rokoch Československa.- After short introduction the paper deals with terminological issues, then it classifies different forms of international participation in the constitution-making process. This participation is not identical with the simple impact of foreign models on the constitution-making. Drawing different levels of inspirations from foreign models is more or less voluntary.Many new countries in Europe in the 19th century followed the model of Belgian constitution from 1831. The impact of British and French solutions was very intensive as well. For a long period in the 20th century Soviet-Russian
constitutional model was highly influential . Active international legal and political assistance in constitution-making is a different matter. The involvement of international factors in these processes can be direct or indirect. The paper focuses first on the hard form, then on the soft form of international legal assistance.Although the paper concentrates on the development in the 20th century, it briefly covers the events of the 19th century (state-building in Balkan) as well. Final part of the paper focuses
