Situated along the Croatian coastline, in the area outside the ports, there are 50 lighthouses which, in accordance with the provisions of the Maritime Code and the Plovput Act, are managed by the ...company Plovput d.o.o. According to the current legislation, the legal status of lighthouses is in doubt, which in practice makes it difficult to properly manage these valuable facilities of importance for the safety of navigation in the Adriatic. The Ministry of the Sea, Transport and Infrastructure has formed a working group to draft a proposal for amendments to the Plovput Act. One of the objectivesof amending the Act (or passing a new one) is to ensure better management of lighthouses, given their importance for the safety of navigation, but also for their traditional and cultural values. The prerequisite for achieving this goal is the clear regulation of the legal status of lighthouses.This paper provides an overview of the existing legal framework which could apply to lighthouses, and highlights the divergent practice among the State Attorney’s Office, the courts and the Maritime Property Boundary Commission regarding their legal status. It seeks to offer proposals for possible solutions to regulate the legal status, to determine the lighthouse area and registration in the cadastre and land registers and to give guidelines for drafting a legal framework for the management of lighthouses. Additionally, given that Plovput d.o.o. has concluded contracts for the restoration and lease, or contracts for lease, of 17 lighthouses, a model is proposed to regulate the rights and obligations arising from such contracts.Finally, the issue is raised of the suitability of the new or amended Plovput Act for regulating these questions.
The maritime domain in the Republic of Croatia has a special legal status – it represents a common good, res extra commercium, so it is outside the ownership regime and is managed by the Republic of ...Croatia according to special regulations. Such a definition of maritime domain, which includes the sea coast, has great consequences for its overall use, protection and economic activities, which must be performed on the maritime domain under special regulations based on a concession or concession approval. Although the demarcation of the maritime domain in the field is extremely important, in practice it is extremely slow and is done only upon request – which leads to serous legal uncertainty. For more than 30 years since its independence, the Republic of Croatia has not had a precisely defined border to its maritime domain. Therefore, the existing model for determining the boundary of the maritime domain on the ground needs to be modernised and a goal must be set – determining the boundary of the maritime domain on the entire Croatian coast, which would not only legally harmonise the situation, but also increase legal certainty. The existing literature on the maritime domain speaks of the legal nature of the maritime domain, border demarcation, economic use, and other aspects, but not enough is written about the organisational and procedural preconditions for extensive work to be done on delimiting the maritime domain in the Croatian Adriatic.
Celem artykułu jest zaprezentowanie kategorii dobra dziecka w badaniach nad dzieciństwem. Przedstawiono w nim wyniki eksploracji nad tym zagadnieniem, którą przeprowadzono z perspektywy samego ...dziecka. Tło tych badań stanowi przegląd współczesnych rozważań nad dzieckiem i dzieciństwem, z zaznaczeniem dominujących w nich perspektyw oraz dyskursów. Do pożądanych współcześnie perspektyw należą badania „z dziećmi”. Pedagodzy podkreślają też koncepcję dziecka jako obywatela, a także wskazują na potrzebę prowadzenia badań w zakresie partycypacji dzieci w procesie budowania demokracji. Dyskurs o dobru dziecka w badaniach nad dzieciństwem został zaprezentowany w nawiązaniu do koncepcji Wendy Stainton Rogers, według której rozpatruje się je przez pryzmat potrzeb, praw i jakości życia dziecka. W dalszej części artykułu przedstawiono rozumienie kategorii dobra dziecka w pedagogice, zaś w ostatniej części zarysowano propozycję badań w zakresie doświadczania jakości życia przez dziecko. Przyjęto, że dobro dziecka z jego osobistej perspektywy jest uchwytne w doświadczeniu indywidualnym. W takim znaczeniu stanowi ono wartość subiektywną i może być analizowane w kontekście poznawczo-przeżyciowej teorii „ja” Seymoura Epsteina.
U radu se analizira pravni status javnog dobra kao i općeg dobra u Republici Hrvatskoj. Također se daje komparativni prikaz statusa pomorskog dobra u nekoliko europskih država kao i država pravnih ...sljednica Socijalističke Federativne Republike Jugoslavije. Na kraju daje se stav autora o tome da bi i pomorsko dobro u budućnosti trebalo imati pravni status javnog dobra u vlasništvu Republike Hrvatske.
The paper analyses the legal status of a public good as well as the common good in the Republic of Croatia. It also gives a comparative overview of the status of maritime goods in several European countries as well as the state legal successor of the Socialist Federal Republic of Yugoslavia. Finally, given the attitude of the authors on how to make the maritime domain in the future should have the legal status of public goods owned by the Croatian.
Nastavno na objavu potrebe donošenja novog Zakona o Plovputu, Split, u doktrini i praksi postavilo se pitanje što bi navedeno moglo značiti za rješavanje problematike neujednačenog pravnog statusa ...svjetionika na hrvatskoj obali. Pokušavajući odgovoriti na navedeno pitanje, autori u radu analiziraju normativno uređenje pravnog statusa svjetionika koji se nalaze na hrvatskoj obali. Posebice se razmatraju zatečeni imovinskopravni odnosi, koji uključuju ugovorne odnose s trećim osobama kao i eventualna stečena prava i legitimna očekivanja pravnih subjekata na svjetionicima. Kao nužan preduvjet rješavanja te problematike analiziraju se primjenjivi propisi koji reguliraju formiranje katastarske čestice svjetionika, njezine evidencije, ali i moguća primjena instituta izvlaštenja. Daje se prikaz upravne i sudske prakse o pravnom statusu svjetionika. Razmatra se pravni i računovodstveni status svjetionika kao imovine društva Plovput d.o.o. Zaključno, u svrhu postizanja adekvatne razine normiranosti i uređenja zatečenih imovinskopravnih odnosa, predlaže se mogući smjer uređenja pravnog statusa svjetionika novim Zakonom o Plovputu, Split.
