This research aims to (1) identify the difficulties students face in the Islamic jurisprudence (fikih) subject; (2) present the teaching materials used in fikih learning; (3) assess the effectiveness ...of the teaching materials used by teachers in helping students understand the subject; (4) identify the topics that students find challenging in the fikih subject; (5) describe the needs analysis for the development of an e-module teaching material in the fikih subject at a secondary Islamic school (MA). In this study, the researcher applied the research and development (R&D) method using the 3D research method (define, design, develop), with a focus on the define stage. To collect information and data, the researcher used an online questionnaire distributed to tenth-grade students at MA Darul Ulum Palangka Raya. The analysis technique employed was qualitative descriptive analysis. Based on the survey responses, the researcher concluded that (1) the majority of students do not find the fikih subject difficult; (2) the teaching materials used in fikih include textbooks and worksheets (LKS); (3) the teaching materials used by fikih teachers have assisted students in understanding the material; (4) out of the nine fikih topics in the tenth-grade curriculum, two topics, namely the burial of the deceased (pemulasaran jenazah) and purification (taharah), are considered challenging by students; (5) 71.9% of students are interested in using an e-module for fikih learning.
Fiqh material requires a special skill for an educator in delivering it, let alone intersect with the problem of delivering material that considered taboo by both educators and students. Like ...delivering material about the purification of the big hadas (Mandi Junub), also conveyed the material of the request prayer, and fasting (Haid, Nifas Jimak). The skills of a teacher are needed in order to convey taboo material in Fiqh to level students elementary school in proportion. This article aims to analyze the skills of an educator in delivering Fiqh material which is taboo provide understanding to elementary school students. This article will studied using descriptive qualitative research methods by going directly to the field searches for data and narrates the data with a theory that concerned. The results of this study educators need special skills in teaching in order to be able to convey Fiqh material that is considered taboo to level students elementary school properly and in proportion. The jurisprudence of al-Ma’ālāt is an ancient jurisprudence rooted in Islamic law, and it is concerned with analyzing and taking into consideration the consequences and results people’s actions can ...generate. The Fiqh was used by the Prophet and Sahaba, and it, thereafter, became so famous during the period of Imam Abu Hanifah, the founder of the Hanafi School of Jurisprudence. Fiqh of al-Ma’alat is a great distinctive feature and one of the important jurisprudential aspects of the Hanafi School. The school makes copious use and reference to the theory and practices of al-Ma’ālāt. Where the Hanafi school uses the term “Ariat i.e., have you pondered if that happened” and then builds the fatwa ruling based on this future event and also on the expected results of this event. History also mentions Al-Shaṭibī’s attempts to draw the attention of the imams of his time to the importance of this jurisprudence through his book Al-Muwafaqāt. But despite all the attempts, the writings on it are still few compared to Maqasid Al shariah, and the writings in it in Islamic economics and finance in the English language are almost non-existent, as there is only one source in English according to the researcher’s knowledge. Unusually however, this important discipline was not given adequate attention especially by later scholars. Despite its significance. The reasons behind that, as the researcher think due to it is not easy to discover and need deep knowledge and interdisciplinary approach which not easy for each imam to discover or can do it. This article is an attempt to restore interest in it by looking at it through several Islamic, economic and administrative aspects, but to start with this jurisprudence to “gain an understanding of the existing research and debates relevant to a particular topic or area of study, and to present that knowledge in the form of a written report. You will also gain insight into how researchers apply the concepts you are learning in your unit to real world problems.
Presenting the emergence and development of ijmāʿ, this paper aims to epistemologically critique the articulation of ijmāʿ in modern Western scholarship on Islam. The article argues that to ...understand ijmāʿ, we need to explore its social context, theological foundations, and practical consequences. A tolerance of the difficulty in identifying truth, an understanding of the law as being built on uncertainty, and employing jamʿ, as an assemblage are essential dynamics in the formation of the law and Muslim societies. The corpus of classical literature on ijmāʿ is expectedly contradictory, and full of gaps. Rather than seeing this as problematic, the article recognizes it as normative. Against the argument that ijmāʿ was the “foundation of foundations,” or that it was a well-defined concept that gained political power against adversaries, the article argues that in practice ijmāʿ remained marginal, and confined to the minimum necessary for each individual to be a member in the Muslim community.
Chemical castration is a punishment against pedophiles, who have committed acts of crime that are considered an extraordinary crime. Pedophiles have ruined the future of children, with tremendous ...psychological and environmental impacts. This paper aims to uncover the problems of fiqh in Indonesia concerning chemical castration which has the aim of providing a deterrent effect for rape perpetrators of children. The data collection method in this study uses the literature study. There are differences in the views of legal experts with doctors. Legal experts decide on penalties for pedophiles with Law Number. 17 of 2016 concerning the Second Amendment to Law Number. 23 of 2002 concerning Protection of Children, while the Indonesian Doctors Association states reject chemical castration punishment, following the Code of Ethics as stated in the rules of the Medical Code of Ethics Assembly (MKEK) Number. 1 of 2016 concerning Chemical Castration. Fiqh experts disagree over the castration penalty for chemistry. There is no castration punishment in the fiqh, because the Prophet Muhammad forbade castration, as opposed to Islamic principles. Some fiqh experts agree that chemical castration punishment includes ta'zīr, which is a sentence handed over entirely to the legitimate government. Thus, although the castration chemical punishment has been determined, in its implementation there are problems because there are still rejections and problems according to the fiqh expert
Purpose: This paper aims to analyze the jurisprudence of prayer in the ocean based on the book Is'af Ahl Al-'Asr Bi Ahkam Al-Bahr and identify the problems that often occur when performing prayer. ...Theoretical framework: This book was chosen because it touches on and discusses the laws of maritime jurisprudence related to prayer. In this book, there are seven main chapters, namely water, purification, prayer, funeral, fasting, zakat and Hajj. Design/methodology/approach: this study does not discuss all chapters in this book but analyzes selected topics according to the problems of prayer that often occur while at sea. This study uses a qualitative method with a library research design, while data collection is done through the study of documents obtained through books, articles and journals related to the research topic. This study also used the method of interviewing respondents involved in research in the ocean to obtain data. Next, the data obtained is analysed using content analysis to obtain accurate research findings. Findings: The study found that the implementation of prayer in the ocean has a method and guide in the Sharia based on the book Is'af Ahl Al-'Asr Bi Ahkam Al-Bahr. Discussion: The responsibility as a Muslim in prayer in the ocean field can be carried out perfectly with the existence of accurate guidance according to Islamic teachings.
This research was prompted by a preliminary study at MTs Cijaura, MTs Sirnamiskin, MTs Nurul Iman, and MTs Pulosari, which revealed that teachers have not been able to fully develop fiqh learning ...evaluation instruments that accommodate cognitive, affective, and psychomotor aspects for students with diverse understandings in Fiqh learning. The aim of this research is to develop a fiqh learning assessment instrument based on religious moderation at Madrasah Tsanawiyah. The research method utilized the R and D research ADDIE model (Analysis, Design, Development, Implementation, Evaluation), with data collection techniques involving observation, interviews, questionnaires, and documentation. Qualitative data validity testing assessed the truth and reliability of the collected data, while quantitative data analysis employed validity and reliability tests. The results of this study indicate that the Fiqh learning assessment instrument can be developed based on the value of religious moderation. The development resulted in the following: 1) Fiqh learning assessment instruments containing religious moderation values, namely tawasuth, tasamuh, tawazun, and I'tidal; 2) Fiqh learning assessment instruments accommodating affective and psychomotor cognitive aspects; 3) The instruments developed received assessments from three expert validators-assessment validators, religious moderation validators, and fiqh field validators-with an average assessment value of 86.24, categorized as highly suitable and ready for testing; 4) The validity test results for the questions showed the largest r score of 0.651 and the smallest of 0.357, while the largest R table is 0.334 and the smallest is 0.321. The data indicates that the tested questions have an r count value greater than the r table, affirming the validity of the questions developed in the field; 5) The reliability test results have a Cronbach's Alpha score of 0.713, exceeding 0.05, confirming their reliability.
