‘Is there some other form of law?’ – that is how Gaius Iulius Caesar (played byCiaran Hinds) in the TV series ‘Rome’ comments on Roman Law. ‘Rome’ (2005–2007) is a historical drama set in the last ...days of the Roman Republic. It is one of the most interesting shows helping to visualize Rome. One of the elements portrayed in the series is Roman Law. Although there is a criminal trial presented in one of the episodes the audience is rarely acquainted with law and its rules directly, Roman legal system can be discovered mostly through characters’ actions. There are many legal elements e.g.:penal trial, executing penalty (damnatio ad gladium ludi), manumission (manumissio),funeral arrangements, or corporal punishment of the soldiers (castigatio). Some of the legal aspects are presented correctly others contain some discrepancies; nevertheless there is a quite interesting portrayal of Roman Law in the series. The aim of the article is to find and describe some legal issues presented in ‘Rome’. It can be both scientific and educational. Nowadays the lecturers search for innovative or more engaging ways to teach, I believe the series could be a useful tool for students of law.
Celem artykułu jest analiza praktyki prawniczej jako drogi intelektualisty – na przykładzie Michaela Sfarda. Sfard jest wybitnym specjalistą adwokatem, który zajmuje się prawami człowieka w Izraelu, ...zwłaszcza w sferze konfliktu między Izraelem a Palestyńczykami. Pośród jego klientów są palestyńskie jednostki i wspólnoty, izraelskie organizacje pokojowe i broniące praw człowieka, włącznie ze znanymi w skali międzynarodowej grupami Pokój Teraz i Przełamać Ciszę. Artykuł składa się z trzech części. Pierwsza skupia się na moralnym i politycznym – kolejność nie jest przypadkowa – wymiarze aktywności Sfarda. Druga omawia specyfikę działalności prawnej prowadzonej przezeń kancelarii. Ostatnia opisuje niektóre wybrane sprawy, którymi zajmował się Sfard. W podsumowaniu zwraca się uwagę, że Sfard przez wielu swoich rodaków – szczególnie o poglądach prawicowych, które zdominowały izraelską scenę polityczną – postrzegany jest jako wróg państwa żydowskiego, a nawet zdrajca. Nie powinno to dziwić, nieomal bowiem z definicji intelektualista jest osobą znajdującą się na marginesie, outsiderem.

The Croatian legal system is traditionally under the dominant influence of the Germanic legal tradition. This is a logical consequence of historical circumstances, which state that present-day ...Croatia was long part of the Austro-Hungarian Empire. In the field of criminal law, which is the focus of this paper, there is a significant influence of Austrian, German, and Swiss criminal law. However, since 2008, new trends have emerged, first evident in procedural law (through the introduction of the previously typical AngloAmerican institution of plea bargaining in criminal proceedings), and then from 2013 also in substantive criminal law. In the Criminal Code of 2013, sexual offenses were modeled after the English Sexual Offences Act of 2003, which has sparked considerable controversy in theory and practice. In this text, the author critically examines this legislative shift in tradition from the perspective of comparing the historical circumstances of the English and Croatian criminal law backgrounds. The author discusses the differences in criminal justice systems of these countries, compares the circumstances of the origin and shaping of sexual offenses in the mentioned legislations, and presents the results of their own research conducted in Croatia, reflecting whether the new legal solution was successful and whether it achieved its purpose. Based on this, the author provides an answer to the hypothetical question of whether a solution implemented from one legal tradition can successfully exist in the conditions of another significantly different legal tradition.
In the first periods, the procedure and methodology of iftâ were discussed in the sections adab al-muftî or adab al-fatwa of fiqh works. In the following process, independent works containing these ...subjects with the same name were written. Among the first independent works on this subject, Ibn al-Salâh’s Edebü’l-müftî ve’l-müsteftî and Ibn al-Hamdân’ın Sıfatü’l-müftî ve’l-müsteftî can be mentioned. In comparison with other madhabs, the independent works on the fatwa methodology of Hanafi were written later. As far as we can determine, the first independent work on Hanafi fatwa methodology is tractate of Mohammed al-Destinâî named Âdâb al-muftîn. Only one copy of this work, which was thought to have been written at the end of the IX. (XV.) century or the beginning of the X. (XVI.) century, was identified. In the work, which consists of four sheets, are included the meanings of the term of fetwa and its derivatives, conditions of the mufti and müstefit. In this article, a tractate named Âdâb al-muftîn, which was the first independent work on Hanafi fatwa methodology and not too much information in sources, and its author will be introduced. In addition, with the thought of contributing to the literature of fetvâ methodology the critical edition of this compendious tractate, will be included.
The article analyzes the biographies of the regional leaders of the Solidarity union and examines the process by which activists were recruited into the social movement and subsequently rose through ...its ranks. Though there exists an abundant body of research on Solidarity, the recruitment process for the trade union’s middle management has never been analyzed. Such an examination of the regional leadership is important given the significant diversity that existed in the selection process. Activists were selected in regions where strikes occurred (Gdańsk and Wałęsa) and in ones where there were no strikes. This article attempts to identify these regional leaders and their role in Solidarity. It poses questions about the social movement’s center of power. Did the regional leadership represent a grassroots social movement, or were they merely carrying out orders from the center? The subject of this analysis is a group of thirty-nine chairmen comprising the regional leadership of Solidarity. The article employs classical historical analysis methods combined with elicited sources (interviews conducted with selected leaders). It presents a prosopographical analysis based on statistical, historical, and sociological data. The questions posed in the article involve such issues as the Solidarity recruitment process, the social backgrounds of the leaders, their individual personality traits and biographical features, and the goals and motivations that led them to join the movement. The analysis reveals the qualities shared by the majority of the regional leadership of Solidarity.
Resumen: El presente artículo trata sobre la cátedra de Historia General del Derecho Español creada en la Universidad de La Habana, a finales del siglo XIX, cuando Cuba se encontraba aún bajo el ...dominio colonial español. La inserción de dicha materia obedeció, en primer término, a su inclusión en los planes de estudios universitarios aprobados en la Península Ibérica, hechos por demás extensivos a la isla. Esto obedeció a una serie de factores como la modernización de la enseñanza universitaria, el desarrollo de corrientes nacionalistas y la influencia de la Escuela Histórica del Derecho. En este artículo se analizarán las condiciones particulares que propiciaron el interés por los estudios histórico-jurídicos en Cuba, así como el programa de la materia señalada y la obra de los profesores que ostentaron la titularidad de dicha cátedra.
