This paper examines the role of the public and its regulation in the Croatian parliamentary law within the formative period of establishing state institutions and law from 1947 to 1953. In trying to ...determine what is meant by the term public, the author uses etymological and historical approach, exposes the main theoretical concepts and takes a brief look at the socio-political context in the period under review. After that, the author gives a normative analysis of the relevant provisions of the Rules of Procedure of the Parliament of the People’s Republic of Croatia dating from 1947 and 1951, outlines the provisions of the following Rules of Procedures to give an overview of the gradual forming of regulation of the public to the present day. Finally, in giving his concluding observations the author confirms his hypothesis that the public in the reviewed period of the Croatian parliamentary law did not have any significant role; it was reduced only to the meaning of audience, without any possibility of direct influence on the decisions in legislative or norm-making process, while the outcome of the use of available procedural instruments (opinions, requests, complaints and petitions) was entirely dependent on the will of the competent committee or parliament.
Eine Flexibilisierung des zu starren Schrankenkatalogs des deutschen und europäischen Urheberrechts ist dringend erforderlich. Dies zeigt sich insbesondere bei der Konfrontation der Schranken mit ...neuartigen Formen der Werknutzung. Im Rahmen der technologieneutral und wertungsoffen ausgestalteten Fair Use-Schranke des US-amerikanischen Urheberrechts gelingt es hingegen deutlich problemloser, auch einer veränderten Werknutzungsrealität gerecht zu werden. Rechtsvergleichend untersucht der Autor, wie sich aus Erkenntnissen zur Fair Use-Schranke und dem im europäischen und internationalen Recht etablierten urheberrechtlichen Dreistufentest eine Auffanggeneralklausel gestalten lässt, die den zu starren Schranken der InfoSoc-Richtlinie bzw. des UrhG die erforderliche Flexibilität verleihen könnte, ohne als Fremdkörper im europäischen Recht zu erscheinen.
In this paper, the author outlines current rules of procedure of the Croatian parliament, the Assembly of the Republic of Macedonia, the Slovenian National Assembly and the National Assembly of the ...Republic of Serbia in order to compare provisions which regulate the procedure for preparing and adopting an authentic interpretation of the law. In addition, the author examines the parliamentary practice to determine the frequency of adopting an authentic interpretation of the law. For this purpose, the author analyses relevant provisions, parliamentary practice as well as practice of Constitutional Courts and the data published on the website of parliaments and in the official gazettes of these four states. The starting hypothesis is that, despite some specific solutions, there is a general similarity in the process of preparing and adopting an authentic interpretation of the law in these four states, followed by frequent use of authentic interpretation from all four parliaments.

U radu se razmatra postupak za autentično (vjerodostojno) tumačenje zakona u hrvatskom, makedonskom, slovenskom i srbijanskom parlamentarnom pravu, kako bi se istražilo postoji li sličnost u postupku ...pripreme i davanja takvog tumačenja u četirima državama bivše SFRJ koje su zadržale taj institut, te se analizira parlamentarna praksa tih četiriju država, kako bi se istražila učestalost njegova korištenja. U tu svrhu, u radu se analiziraju relevantne odredbe, parlamentarna i ustavnosudska praksa, podaci objavljeni na internetskim stranicama parlamenata i u službenim listovima tih država na temelju kojih se izvode određeni zaključci. Polazišna teza je da, unatoč nekim specifičnim rješenjima, postoji načelna sličnost u postupku pripreme i davanja autentičnog tumačenja zakona, ali i da je riječ o institutu koji parlamenti tih država podjednako često koriste.
U radu se pobliže prati razvoj instituta vjerodostojnog tumačenja
zakona u hrvatskom parlamentarnom pravu od 1947. do 2016. i razmatra način njegova uređenja u tom razdoblju kako bi se istražio ...utjecaj prethodnih poslovničkih rješenja na oblikovanje važećih odredbi Poslovnika Hrvatskoga sabora, ali i postojanje pravne osnove ovlasti za davanje takvog tumačenja, s obzirom na to da je od 1990.
ovlast zakonodavca da daje vjerodostojna tumačenja zakona explicite navedena u njegovu poslovniku, dok se među ustavnim odredbama izrijekom ne spominje. Na potonjem tragu, uz kritike dijela stručne javnosti, ističu se ustavnosudska stajališta i primjeri uređivanja ove materije u usporednom pravu te se, naposljetku, izvodi zaključak o zadržavanju tog instituta u hrvatskom parlamentarnom pravu,
ali uz nastojanje da se spriječi učestalo posezanje za njime
i, općenito, ograniči mogućnost izigravanja njegove svrhe.
