Presenting an unprecedented wealth of empirical research, Contested Citizenship compares collective actions by migrants, xenophobes, and antiracists in Germany, Britain, France, the Netherlands, and ...Switzerland. Revealing striking cross-national differences in how immigration and diversity are contended by different national governments, these authors find that how citizenship is constructed is the key variable defining the experience of Europe's immigrant populations.
The large-scale establishment of ethnic minorities and diasporic communities in Europe has gained the attention of social science scholars for a number of decades now. However, legal interest in this ...field has remained relatively underdeveloped, and few scholars have addressed emerging legal issues to any significant degree. This collection of contributions by leading writers in the field of ethnic migration and diaspora studies therefore provides some important interdisciplinary perspectives of how ethnic/diasporic minorities in British and European contexts interact with the official legal system. This volume makes a significant contribution in assessing the role of law in current debates on the integration of ethnic and religious minorities of migrant origin in the EU. The chapters derive from papers first delivered at a lecture series on 'Cultural Diversity and Law' at the Institute of Advanced Legal Studies. The contributors' disciplinary interests range across law, anthropology, sociology, geography and political theory, and each one addresses the issues within his or her field of study by adopting approaches that place law within its wider social and political context. The topics covered range from a number of 'public' and 'private' law issues as well as the more conceptual realms of jurisprudence. They include marriage laws, approaches to dispute resolution, the role of courts and juries in the criminal justice system, drugs policies and the criminalisation of minorities, free speech and blasphemy, planning laws and the construction of religious buildings, composition of the judiciary, the normative foundations of cultural diversity in law, and integration and law. The compilation should therefore attract an interest beyond its core readership in law, making legal issues accessible to a whole range of students and policy makers within the social sciences.
Is it possible for the state simultaneously to respect deep cultural differences and to protect the hard-won citizenship rights of vulnerable group members, particularly women? This 2001 book argues ...that it is not only theoretically needed, but also institutionally feasible. Rejecting prevalent normative and legal solutions to this 'paradox of multicultural vulnerability', Multicultural Jurisdictions develops a powerful argument for enhancement of the jurisdictional autonomy of religious and cultural minorities while at the same time providing viable legal-institutional solutions to the problem of sanctioned intra-group rights violation. This new 'joint governance' approach is guided by an innovative principle that strives for the reduction of injustice between minority groups and the wider society, together with the enhancement of justice within them. This book will interest students of political and social theory, law, religion, institutional design, as well as cultural and gender studies.
Multiculturalism is one of the most controversial topics in both the United States and Germany. This interdisciplinary collection of essays by German scholars in American Studies and American scholars ...in German Studies analyze the "other" from this dual perspective and from their respective disciplines such as literary and cultural studies, political science, anthropology, and history. More particularly they examine multiculturalism in terms of national and ethnic identities, as well as gender and race, and look at the disciplines and institutions that produce and legitimize discourses on subjects such as minority literatures, feminism, and the notion of foreignness itself. What becomes clear is the fact that careful attention must be paid to the particular conditions and different ideological concepts that shape this term, i.e., the "national" historical, political, social, and institutional contexts in which it appears, circulates, and accrues meanings.
This book explores the rights and situations of ethnocultural groups in Western democracies. It presents essays that share three major themes: the dialectic of nation building and minority rights, ...the gap between theory and practice of liberal democracies; and the effectiveness of emerging forms of nation-building and minority rights in Western democracies. The book is divided into four parts. Part I presents debates on the rights of ethnocultural minorities. Part II discusses the requirements for ethnocultural justices in a liberal democracy. Part III examines liberals’ misconceptions about nationalism. Part IV focuses on how democratic citizenship can be sustained.

The concept of heritage relates to the ways in which contemporary society uses the past as a social, political or economic resource. However, heritage is open to interpretation and its value may be ...perceived from differing perspectives - often reflecting divisions in society. Moreover, the schism between the cultural and economic uses of heritage also gives rise to potential conflicts of interest.
Examining these issues in depth, this book is the first sustained attempt to integrate the study of heritage into contemporary human geography. It is structured around three themes: the diversity of use and consumption of heritage as a multi-sold cultural and economic resource; the conflicts and tensions arising from this multiplicity of uses, producers and consumers; and the relationship between heritage and identity at a variety of scales.
