Normativno skrb za komuniciranje so avtorji poročila Mnogo glasov, en svet utemeljili na pravici do komuniciranja, ki zadeva državljanske zmožnosti biti informiran, izražati mnenje in participirati v javnem življenju, ter se odmaknili od razumevanja svobode tiska, ki sloni predvsem na lastninski pravici. Na podlagi teorije delovnega procesa članek razgrinja logiko razsposabljanja novinarjev in proučuje implikacije deprofesionalizacije novinarstva za uveljavljanje pravice do komuniciranja, pri čemer se podrobneje ukvarja s pojavi prekarizacije, protrošništva in robotizacije v novinarstvu.
The article derives from debates on impoverishment of journalism as labour that has been through technological innovations historically torn between business goals aimed at realizing profits for media owners and journalistic goals of connecting citizens to social life grounded on the right to communicate. The authors of the report Many Voices, One World based their normative concerns for communication on the right to communicate that concerns citizens' abilities to access information, voice opinions and participate in public life and thereafter departs from understandings of press freedom that rest on property rights. By adopting the labour process theory the article reveals the logic of deskilling of journalists and analyses implications of deprofessionalization of journalism for enforcing the right to communicate with a special emphasis on the phenomena of precarization, prosumption and robotization in journalism.

Das Urheberrecht verhindert ein Marktversagen, indem es immaterielle Guter ausschlielich und damit marktfahig macht. Die Ausschlielichkeit hat aber eine Kehrseite: Verbietet der Rechtsinhaber ...Nutzungen, ohne sie (auf eine bestimmte Art) selbst vorzunehmen, liegen vergriffene Werke brach, werden Innovationen behindert und wissenschaftliche Zeitschriften prohibitiv verteuert. Abhilfe konnte die urheberrechtliche Zwangslizenz schaffen. Die im Urheberrechtsgesetz geregelte besondere Art des Kontrahierungszwangs - der Rechtsinhaber muss eine Lizenz erteilen, kann aber die Lizenzbedingungen verhandeln - fuhrt in Literatur und Gesetzgebung ein Schattendasein. Ziel der Arbeit ist es, diese Lucke zu schlieen. Zunachst wird rechtsvergleichend und ausgerichtet am Ziel normativer Effizienz geklart, ob und in welchen Fallen eine urheberrechtliche Zwangslizenz geregelt werden sollte. Anschlieend wird untersucht, wie sie effektiv und mit hoherrangigem Recht vereinbar ausgestaltet werden konnte.
The aim of this article was to analyse the retold experiences of 27 survivors from the 1990s war in Bosnia and Herzegovina. I have examined verbal markers of reconciliation and implacability and ...analysed the described terms for reconciliation that are being actualized in the narratives. The material for the study was gathered through qualitative interviews with 27 individuals who survived the war in north-western Bosnia and Herzegovina. This study joins those narrative traditions within sociology where oral presentations are seen as both discursive- and experience-based. In addition, I perceive the concept of reconciliation as an especially relevant component in those specific stories that I analysed. Stories on implacability, reconciliation, and conditions for reconciliation are not shaped only in relation to the war as a whole but also in relation to an individual's wartime actions and those of others. In these stories, implacability is the predominant feature, but reconciliation is said to be possible if certain conditions are met. Examples of these conditions are justice for war victims, perpetrator recognition of crimes, and emotional commitment from the perpetrator (by showing remorse and shame, for example). Previous research on post-war society emphasized structural violence with subsequent reconciliation processes. Researchers have focused on the importance of narratives, but they have neither analysed conditions for reconciliation in post-war interviews. This article tries to fill this gap by analysing the stories told by survivors of the Bosnian war during the 1990s.
Die Arbeit untersucht den internationalen und unionsrechtlichen Rahmen von urheberrechtlichen Schrankenbestimmungen und zeigt Umsetzungsspielräume für den nationalen Gesetzgeber auf. Sie untersucht ...ausschließlich die Rechtsfolgenseite von ausgleichspflichtigen Schrankenbestimmungen und legt den Fokus auf individuelle und vertragliche Gestaltungsmöglichkeiten. Dogmatische Grundlagen in InfoSocRL, UrhG, BGB und VGG werden unter Beachtung der grundrechtlichen Vorgaben (GG, GRCh) dargelegt. Die Arbeit setzt sich mit der aktuellen Diskussion um eine Verlegerbeteiligung im Rahmen von § 63a UrhG auseinander. Abschließend wird eine Änderung des § 63a UrhG empfohlen, damit die Ausgestaltung der gesetzlichen Vergütungsansprüche den Interessen von Urhebern, Verwertern und Nutzern besser gerecht werden kann.Die Arbeit ist sowohl für Urheber, Verwerter und Verwertungsgesellschaften von praktischer Bedeutung.
Gegenstand der Arbeit bildet die aus Skandinavien stammende Rechtsfigur der "Erweiterten Kollektiven Lizenz" ("extended collective license"), welche über die Erstreckung von Kollektivverträgen die ...Lizenzierung von umfassenden Werkrepertoires an Nutzer ermöglicht. Trotz ihrer wachsenden Popularität ist die Erweiterte Kollektive Lizenz wissenschaftlich noch nicht annähernd erschöpfend behandelt worden. Vor diesem Hintergrund werden anhand einer umfassenden Analyse zunächst das Wesen, die Struktur sowie die maßgeblichen Aspekte dieser Rechtsfigur näher untersucht. Aufbauend auf diesen Erkenntnissen widmet sich die Arbeit anschließend der Frage, ob und inwieweit die Erweiterte Kollektive Lizenz im Einklang mit höherrangigem Recht in Deutschland und Europa in Zukunft nutzbar gemacht werden könnte. Gerade an der Nahtstelle von Exklusivität und Kollektivierung vermag das Modell in bestimmten Bereichen den erforderlichen Interessenausgleich im Urheberrecht zu gewährleisten.
