Vor den deutschen Zivilgerichten klagen zunehmend Spieler, die vor der weiteren Liberalisierung des Glücksspielrechts im Jahr 2021 an Glücksspielen im Internet teilgenommen haben. Sie fordern von ...Unternehmen, die solche Glücksspiele anbieten, die Rückzahlung geleisteter Spieleinsätze. Diese so genannten "Spielerklagen" waren bisher unterschiedlich erfolgreich. Die deutschen Gerichte sind sich zwar weitgehend einig, dass die Spielverträge wegen Verstoßes gegen die bisherigen Glücksspielstaatsverträge nach § 134 BGB unwirksam sind, obwohl die Glücksspielaufsicht bewusst das bisherige Glücksspielverbot im Internet nicht durchgesetzt hat. Vielmehr hat die staatliche Aufsicht Verstöße der Unternehmen geduldet, wenn sich die Unternehmen an bestimmte Vorgaben der Behörden halten, um zu verhindern, dass Spieler auf ein gänzlich unreguliertes Angebot ausweichen. Uneinigkeit besteht aber, ob etwaige bereicherungsrechtliche Ansprüche nach § 817 Satz 2 BGB gesperrt sind. Dagegen haben die Gerichte deliktische Schadensersatzansprüche der Spieler bisher nur vereinzelt bejaht. Auch die Verjährung etwaiger Ansprüche wirft Fragen auf. Zu diesen privatrechtlichen Aspekten der Spielerklagen, die bisher noch nicht umfassend diskutiert wurden, nehmen die Beiträge dieses Bandes Stellung.
Nach §1066 ZPO gelten die Vorschriften über vertraglich vereinbarte Schiedsgerichte entsprechend für "Schiedsgerichte, die in gesetzlich statthafter Weise durch letztwillige ... Verfügungen ...angeordnet werden". Während solche letztwilligen Schiedsverfügungen im 20.Jahrhundert sehr selten waren, beschäftigen sie heute die deutschen Gerichte mit gewisser Regelmäßigkeit. Mit Zunahme der praktischen Relevanz rücken auch die dogmatischen Grundlagen letztwilliger Schiedsverfügungen in den Fokus: Warum darf der Erblasser nicht nur materielle, sondern auch prozessuale Verfügungen von Todes wegen treffen? Wie weit reicht die Zuständigkeit des letztwillig eingesetzten Schiedsgerichts? Und welches Recht ist anzuwenden, wenn der Erbfall grenzüberschreitende Bezüge aufweist? Jakob Gleim beantwortet diese Fragen und bezieht dabei im Rahmen eines Rechtsvergleichs auch das US-amerikanische Recht ein. Fürdie vorliegende Dissertation wurde Jakob Gleim mit der2020 der Max-Planck-Gesellschaft ausgezeichnet.

Der Autor zeichnet ein lebendiges Bild der Rechtstatsachen und leistet so auch einen Beitrag zur Beleuchtung der Schattenseiten der jüngeren Wirtschafts- und Sozialgeschichte Japans, einschließlich des illegalen Inkassos und der Schuldnersuizide. In the nearly 40 years since implementation of federal regulations governing the protection of human participants in research, the number of clinical studies has grown exponentially. These studies ...have become more complex, with multisite trials now common, and there is increasing use of archived biospecimens and related data, including genomics data. In addition, growing emphasis on targeted cancer therapies requires greater collaboration and sharing of research data to ensure that rare patient subsets are adequately represented. Electronic records enable more extensive data collection and mining, but also raise concerns about the potential for inappropriate or unauthorized use of data, bringing patient protections into a new landscape. There are also long-standing concerns about the processes and forms used to obtain informed consent from patients participating in clinical studies. These changes and challenges raise new ethical and practical questions for the oversight of clinical studies, and for protecting patients and their health information in an efficient manner that does not compromise the progress of biomedical research.
Contemporary Issues for Protecting Patients in Cancer Research is the summary of a workshop convened by the National Cancer Policy Forum of the Institute of Medicine in February 2014 to explore contemporary issues in human subjects protections as they pertain to cancer research, with the goal of identifying potential relevant policy actions. Clinical researchers, government officials, members of Institutional Review Boards, and patient advocates met to discuss clinical cancer research and oversight. This report examines current regulatory provisions that may not adequately protect patients or may be hindering research, and discusses potential strategies and actions to address those challenges.

Their death or survival depended largely on what racist, national, political or occupational tags the SS had assigned to them and on the circumstances and the date of their arrival in the camp. The twenty-one papers in this volume present a new assessment of the inmates’ worlds of living and show how diverse the “prisoner society” was when seen through the microscope of oral history.

Ihr Tod oder Überleben hing stark davon ab, in welche rassistischen, nationalen, politischen oder beruflichen Kategorien sie von der SS eingeordnet wurden und unter welchen Bedingungen und wann sie ins KZ gekommen waren. Die 21 Beiträge dieses Buches präsentieren eine Neueinschätzung der Lebenswelten der Häftlinge und zeigen, wie vielfältig die "Häftlingsgesellschaft" gewesen ist, wenn man die mikroskopische Sicht der Oral History einnimmt.

This year, Aristotle readers could purchase something old and something new for their libraries. The old thing is Diana Quarantotto's edited volume on Aristotle's Physics I, published in 2018 but now ...finally available in paperback at an affordable price. People will remember that this book includes excellent commentaries on each chapter of Physics, like those by Andrea Falcon, Timothy Clarke, Laura M. Castelli, Lindsay Judson, David Charles, and Isván Bodnár, to name a few. The volume also contains a preface, an illuminating methodological introduction, and a collaborative translation of Aristotle's text. The main takeaway is a balanced appraisal of the importance of Physics I and its introductory role within Aristotle's physical project.
