    A sales contract is an extremely widespreade consensual contract in Roman as well as in contemporary Slovenian law. Its rules are also meaningfully used inother contracts, especially the rules of ... seller liability for factual defects of a purchased item. The seller of the sold item is liable for a factual defect of the sold item only in case when the following preconditions are fulfilled at the same time: the sold item has a defect, the cause of the defect originates from the seller's side, the purchaser did not know about the defect at the moment of entering into the contract, the purchaser notified the seller about the defect in time, the time limit for the notification depends on whether the defect was patent or latent.
