    Serbs are the second most numerous ethnic community in Slovenia and are well established on Slovenian territory for centuries. Their numbers have been increasing throughout history and are today ... unevenly distributed throughout the country, most notably but not exclusively in larger urban and industrial centers. Serbs have formed many different associations, organizations, cultural and folklore groups throughout the years, but only relatively recently managed to organize centralized representation for their ethnic community – since they are not recognized as an official national minority and are struggling for effective protection of their rights in the residing country. Special constitutional rights grant protection of minorities based on the principle of positive discrimination, which binds the Slovenian state to guarantee and effectively support national minority rights, is not based on the numerical strength of a certain community, but rather on the not-precisely-defined principle of autochthony in Slovenian law. Serbian community is one of those (most commonly national communities from ex-Yugoslav countries) who are not recognised as autochthonous by Slovenia, and are colloquially referred to as “new minorities”. Consequently, the Serbian community in Slovenia faces numerous obstacles when it comes to recognition, implementation and effective protection of their rights. Though there have been minor improvements in recent years, the effective protection of their rights seems to be stuck in a constitutional legislative deadlock. The principle of autochthony is problematic in numerous aspects; however, it remains the main cause of the problem and does not enable the dynamic approach to understanding and managing the diversity of Slovenian society.
